COMPETITION RULES:

GENERAL DESCRIPTION:
Quiksilver, Inc. (“Quiksilver”) provides the " ROXY Follow Your Heart Contest" World Wide Web Site (the “Site,” located at http://www.roxy.com), together with the advertising and content on the Site and any related services or contests (collectively, the “Services”), subject to your compliance with the terms and conditions set forth in this agreement (the “Agreement”). This Agreement is made between Quiksilver and you, as a Site visitor or Member (“you”). By using the Site or participation in any contest associated therewith, you agree to be bound by these terms and conditions, its Privacy Policy or other agreement you are required to enter into with Quiksilver in conjunction with your use, or participation in a contest.

If you do not agree to these terms and conditions, please do not use the Site or participate in any contest associated therewith.

Quiksilver reserves the right at any time to: (1) change the terms of this Agreement; (2) change the Site or the Services, including eliminating or discontinuing any content on or feature of any Site; or (3) impose or change any fees or charges for use of the Site or Services.

SUBMISSIONS FOR GRAND PRIZE AND SECOND PRIZE:
You must be 13 years of age or older as of April 15, 2008 to enter. You must be a valid United States or Canadian citizen to enter. All photos and videos must be of entrant's original creation. All entries must be Follow Your Heart Tour related and depict or explain how you are currently or want to Follow Your Heart and how $10,000 could help you on your path. If music is used in video it must be entrant’s original creation and not ‘borrowed’ or ‘shared’ from another artist. Videos must be no longer than 3 minutes.
You will provide a short, creative digital video program of 2-3 minutes in length (“Video Submission”) to Quiksilver that shows her goals and dreams for her future career or hobbies and explains how she would use the prize money to achieve or try to achieve those goals and dreams. Programs longer than 3 minutes will not be eligible and will not be included in the contest.

SUBMISSION PERIOD:
Submissions will be accepted during the period starting from April 15, 2008 at 12:00:01 AM (Pacific Standard Time) and ending August 1, 2008 at 11:59:59 PM (Pacific Standard Time) (“Submission Period”). All Submissions must be received during the Submission Period and no later than 11:59:59 PM (Pacific Standard Time) on August 1, 2008 by Quiksilver to be considered a Qualifying Submission and to be eligible for inclusion in the contest or to be eligible to win.

JUDGING:
Video Submissions that are Qualifying Submissions will be judged by Quiksilver for the Grand Prize in its sole discretion, and its decision will be final and binding and, for the Second Prize, by the public based on the most number of votes. One (1) Video Submission will win the Grand Prize and one (1) Video Submission will win the Second Prize (together, the “Video Winner(s)”). The Video Winners will be announced on the Site by August 15th, 2008.

If a selected winner cannot be contacted, is ineligible, fails to claim the prize, or fails to timely return the completed and executed declaration and release as required, the prize may be forfeited and an alternate winner selected in a manner determined by Quiksilver, in its sole discretion. In the event of a dispute regarding who submitted an online entry, the entry will be deemed submitted by the authorized accountholder of the e-mail account from which the submission was received by Quiksilver.

Quiksilver does not guarantee that any Video Submission will be made available on the Site by Quiksilver or will be viewed or viewable by any visitors to the Site and is under no obligation whatsoever to make any Qualifying Submission available for viewing on the Site. Quiksilver is not responsible for any Video Submission that is not successfully received, and is also not responsible for any Video Submission that is lost, damaged, incomplete or misdirected, in whatever format or for whatever reason, under any circumstances.

Please keep a copy of your Video Submission as no Video Submissions will be returned by Quiksilver. Quiksilver reserves the right to destroy, erase, or otherwise dispose of all Video and Submissions. At Quiksilver 's sole option and discretion, any Video Submission may be retained and, in the sole discretion of Quiksilver, exploited, used and reused in any subsequent edition of the contest, or any other event, promotion, advertisement or for any other reason and for any other purpose, whether related to the contest, the Site or otherwise, in any media now known or existing or hereafter invented, discovered or created, in perpetuity, throughout the universe.

Quiksilver reserves the right to edit and/or alter any Video Submission in any manner whatsoever and you waive any rights of “droit moral” or other similar rights. However, Quiksilver is not obligated to use, edit and/or alter any Video Submission in any manner or for any purpose whatsoever.

Quiksilver’s decisions as to all contest matters are final, binding and nonappealable. All Qualifying Submissions are subject to the terms of these rules and all submitters agree to be bound by these rules and the decisions of Quiksilver.

Quiksilver reserves the right to amend these rules at any time.

Quiksilver may, in its sole discretion, take whatever measures Quiksilver deems necessary or appropriate to preserve the integrity of the contest.

Quiksilver reserves the right to use alternative judging and/or voting procedures, as determined by Quiksilver.

Quiksilver reserves the right to at any time change voting eligibility, contest rules and procedures.

PRIZES:
GRAND PRIZE – One (1) Video Winner will be awarded the Grand Prize consisting of $10,000, which the Winner agrees she will use to work towards accomplishing her goals as described in her winning Video Submission.

VEIWERS CHOICE AWARD – One (1) Video Winner with the most video votes will be awarded the Grand Prize consisting of Roxy product. Approximate retail value $250.00 for the Second Prize

The Prizes will be awarded to the person submitting the Qualifying Submissions, provided they certify and establish to Quiksilver’s satisfaction that they are the owner of the Qualifying Submission and further provided that they have complied with the official rules and have signed all necessary forms and releases as determined by Quiksilver, in its sole discretion.
